YLS Services	LANDSCAPE ARCHITECTURAL DESIGN SERVICES

YLS design services are described in the following sections. Please read the information below to help you decide which services best fit your needs. Conceptual Design Solutions (CDS) related services:

Master Landscape Plans (MLP):

Long-range conceptual
site designs, and strategies that include the following:

MASTER LANDSCAPE PLAN

conceptual site design and location of a new home and/or landscape elements and use areas such as swimming pools, hot tubs, or spas, water features, etc., on the total property or site, whether for a new home or the renovation of an existing home.

conceptual site and circulation system planning and design for drives, parking areas, landings, walks, patios, decks & accessories, and utilities locations.

conceptual grading, drainage, and grade structure design for retaining walls, steps, ramps, inlets, and headwalls.

conceptual planting designs including the selection and location of native, ornamental, and low-water demand (Xeriscape) trees, shrubs, evergreens, ground covers, vines, flowers, ornamental grasses, and lawn areas using cool season (bluegrass or turf-type fescue) or warm season (turf-type buffalograss) or other native grasses and wild flowers.

conceptual irrigation areas and systems using water conservation techniques and equipment.

conceptual landscape lighting fixtures and equipment locations with standard line and low voltage systems.

cost estimates and phasing schedules based on current contractor installed prices or based on do-it-yourself prices at the Owner(s) request.

Area Landscape Plans (ALP):

Conceptual site development plans, designs, and strategies for:

AREA LANDSCAPE PLAN

public or entrance areas, service or utility areas, or private or outdoor living areas.

special use areas or elements inclucing patios, decks & accessories; swimming pools, hot tubs & spas, ornamental pools, water features, water falls, ponds & streams; gazebos, arbors, and trellises; play areas & play structures; fire pits & fire places, buffets & grills, etc.

Detail Design Development (DDD) related services:

YLS will develop detail designs from the previously approved YLS completed Final Conceptual Design Solution (MLP or ALP) or from conceptual designs provided by the Owner(s). YLS will provide plans, pictorial elevations, sections, and details for:

COLORED DETAIL DESIGN PLAN & DETAILS

Doyle/Brown plan

DETAIL DESIGN PLAN

Site Areas & Layouts - detailing to-scale, specific physical shapes, dimensions, locations, & arrangements of objects, and elements on the project site

Grading & Drainage - grading , drainage, and grade structures for all hard surfaces, buildings, landscape elements, plant beds and grass lawns, mounds & berms, lakes and ponds, etc.

Circulation & Paving Areas - for all hardscape paving elements including drives, parking areas, curbs, landings, walks, steps, patios, decks, game areas, etc.

Structural Elements - specifying the exact sizes, materials, colors, and appearance of all structural elements including, retaining walls, screens, fences, etc.

Planting & Lawn Areas - the selections and location of trees, shrubs, ground covers, vines, flowers, grasses, and lawns. YLS specializes in planting designs for residential, commercial, industrial, and public projects using native, adapted, and low-water use (Xeriscape), low maintenance, and ornamental plant materials with multi-seasonal color, and using organic and inorganic mulches in planting bed areas.

Irrigation Systems - the design and selection of all components of an efficient irrigation system, whether with fully automatic controllers, moisture sensors, manual controlers, rotary or pop-up spray heads, bubbler heads, drip-type emitters, or porous pipe.

Landscape Lighting Systems - the designs and selections of all lighting fixtures and locations of all lighting systems components, both standard line (110 volt) or low voltage (12 volt) systems.

Construction Document Development (CDD) related services:

These documents will be to-scale and sufficiently complete for all construction, planting, and installation to be done by the Owner(s) as a do-it-yourself project or by a contractor, and whether coordinated by the Owner(s) or by YLS under the CONSTRUCTION & PLANTING CO-ORDINATION CONTRACT.

Hourly Consultation or Sketches (HCS) related services:

On -or off-site meetings, sketches, inspections, or reports.

CLIENT MEETING

YLS meets with the Owner(s) on the site or in the studio-office to discuss the scope of a particular project and completes a report of simple sketch, either while on-site or after returning to the studio-office, which meets the needs and requirements of the Owner(s) without further preliminary of final design refinements.

Before YLS will begin these hourly consulting services there must be a clear understanding of the scope of the project, the approximate budget range, phasing requirements, and the fees for the hourly consulting service. These services will then be completed on the hourly rate basis currently in force and agreed upon by all parties prior to the start of services, and shall be paid for by the Owner(s) at the completion of the services and/or presentation of an invoice by YLS.*

NOTE:

*If the owner(s) decide to sign a DESIGN SERVICE CONTRACT within 30 days of this hourly consultation meeting, this charge will be credited to the final design fee amount at the completion of the contracted for design services.

GENERAL NOTES TO THE DESIGN SERVICES CONTRACTS

When YOUR LANDSCAPE SOLUTIONS (YLS) meets with the Owner(s) for the first new client meeting to discuss and clarify the overall scope and budget range of the project: Option #1 - in the studio-office (a free 1 1/2 hour +/- meeting) or Option #2 - at the Owner(s)' existing home or on the project site (at $150 per hour while on site with one hour minimum). If the Owner(s) decide to sign a DESIGN SERVICES CONTRACT within 30 days of the first meeting, this charge will be credited to the final conceptual design fee amount.

YLS will furnish two sets of prints of all final plans and construction and planting documents to the Owner(s) at the completion of the FINAL DESIGN phase. One print of the MLP or ALP will be rendered in color. The Owner(s) may obtain additional sets (black and white or colored) from YLS with the charges based on the direct costs plus 20%.

Travel by YLS from the studio-office in Littleton, Colorado necessary for Owner(s) and/or contractor(s) conferences, on-site and nursery and materials suppliers inspecitons, and project co-ordination will be charged to the Owner(s) from the time YLS leaves the studio-office headquarters until such time as YLS returns to said headquarters or arrives at another project site. Automobile travel will be billed at $.38 per mile, out-of-pocket expenses at costs for transportation, meals, and lodging in connection with the project or meetings. Billing for travel charges will be at regular monthly intervals or at completion of phases of contracts or as agreed to at the signing of said contracts.

The Owner(s) may provide an accurate site survey and inventory (SSI) with before photos and/or video, and an accurate Base Plan to-scale (1/8" = 1' or 1/4" = 1') with 1 foot (preferred) or 2 foot vertical contour intervals on reproducible vellum or a computer generated disk (based on Autocadd.dwg Version 2000 or less), at no additional charge. If the Ower(s) chooses to terminate the agreements with YLS, or to abandon the project on which they are working at any stage of its development, YLS shall be compensated at the rate per hour currently in force for all services performed for the Owner(s), up to and including the time of the receipt of written notification from the Owner(s) to terminate the project. The fee for the terminated services shall not exceed the total per the signed DESIGN SERVICES or PROJECT CO-ORDINATION CONTRACT. Credit will be given for any payments received by YLS prior to notification and the balance will be invoiced immediately and payment will be expected within 30 days.

If YLS chooses to terminate the DESIGN SERVICES or PROJECT CO-ORDINATION CONTRACT with the Owner(s) YLS shall notify them in writing and return any portion of payments made less the rate per hour currently in force for all services performed for the
Owner(s) and do so within 30 days of such written notification.

All originals of plans, details, and contract documents shall remain the property of YLS. Said plans, details, and documents are to be used by the Owner(s) or YLS on other projects or extensions of the contracted project only by written agreement with each other.

The scope of Design Services as requested by the Owner(s) shall be established by a LANDSCAPE ARCHITECTURAL DESIGN SERVICES DESCRIPTION, a PROGRAM OF NEEDS & BUDGET RANGE form, the DESIGN PROCESS, these GENERAL NOTES, and a signed CONCEPTUAL DESIGN SERVICES CONTRACT, DETAIL DESIGN DEVELOPMENT SERVICES CONTRACT and/or CONSTRUCTION DOCUMENT DEVELOPMENT SERVICES CONTRACT. Said scope of Design Services shall be a part of and incorporated herein and binding on the Owner(s) and YLS.

PAYMENT FOR DESIGN SERVICES:

Payment for services shall be made at the completion of each phase and/or upon presentation of an invoice to the Owner(s) by YLS.

Conceptual Design & Detail Design Development (DDD) Services shall be paid as follows:

1.)

25% Retainer at the signing of the appropriate DESIGN SERVICES CONTRACT.

2.)

70% of the balance of the contract will be due at the completion of the PRELIMINARY DESIGN phase.

3.)

The remaining balance will be due at the completion of the FINAL DESIGN phase.

Construction Document Development (CDD) Services shall be paid for as follows:

1.)

50% Retainer at the signing of the appropriate CDD contract.

2.)

Remaining balance due at the completion of the appropriate services and presentation of plans.

Other payment arrangements may be negotiated and agreed upon prior to the signing of the appropriate contract.

All accounts are payable and due upon completion of a specific phase and/or the presentation of an invoice and become past due 30 days from the date of invoice. A 2% per month service charge will be assessed for all late payments unless prior arrangements have been made by Owner(s) with YLS.
